Power of Attorney

If you wish to file a complaint with the Immigration Appeals Board and you wish to be represented by another person during the processing of the complaint, please attach a power of attorney to your appeal to the Immigration Appeals Board.

However, if you are represented by a lawyer or a legal aid with insurance, you do not need to enclose a power of attorney with your appeal.

As a rule your spouse will not need a power of attorney if you wish him og her to represent you, but there are exceptions: E.g. your spouse is not considered a party in an appeal case concerning residence permit related to work and study nor in an appeal cases concerning permanent residence. In these cases a written power of attorney is required if your spouse is to represent you.

If you have not submitted a written power of attorney where such is required, the Immigration Appeals Board will ask you to submit a written power of attorney.
